Terms and Conditions

Merri Mysteries is a business name of Acture Pty Ltd.

For the sale of a standard mystery dinner party kit as specified on http://www.merrimysteries.com/tmm/myst.htm using your Quote Number, you will receive a commission.

You can choose whether you want the people you refer to our website to receive a discount off the standard cost of the mystery kit. If you choose to provide a:

• 10% discount – the total commission will be $5 US
• 5% discount – we will increase your commission by the extra $1.50 US, making the total $6.50 US
• no discount – we will increase your commission by an extra $3 US, making the total commission $8 US.

Please just let us know which you would prefer via email to info@merrimysteries.com after your application is approved.

The "Quote Number" is a unique identifying number given to you. When the customer enters this Quote Number on the Merri Mysteries secure online order form, they will receive the kit for at least 10% less than the standard price of the Product.

We reserve the right to reject orders that are for products or services which we do not provide. We will be responsible for all aspects of order processing and fulfillment. We will track sales made to customers who purchase Products using your Quote Number. You will be able to access a web page which allows you enter your Quote Number and see the number of sales made using that Quote Number.

You will be sent a check in Australian dollars every quarter after the months of March, June, September and December or until this Agreement is terminated (if earlier) for the sales made using your Quote Number. This payment will be the equivalent in Australian dollars of your sales in US dollars at the time of the creation of the check. You will be responsible for the payment of all necessary taxes from this income according to the requirements in your country. If you are an Australian, you must supply an ABN number in your application.

You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your web site or otherwise, that reasonably would contradict anything in this Section.

We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under this Agreement.

We make no express or implied warranties or representations with respect to the Program or any products sold through the Program (including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

This Agreement will be governed by the laws of the Australia and the state of Queensland, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Queensland, Australia, and you consent irrevocably to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

Acture Pty Ltd retains the right to terminate this agreement at any time after providing a month's notice in writing and paying any outstanding amounts.
